Consent to use Microsoft Teams

Please only participate in our online meeting if you wish to submit this declaration of consent: By participating in the Microsoft Teams Meeting, I consent to the processing of my personal data for the purposes of the online meeting - also by Microsoft Corporation in the USA.



My consent relates to the transfer of personal data to the USA. Microsoft Corporation is based in the United States. There is no level of data protection comparable to EU standards. There are also no other adequate guarantees for data transmission. There is therefore a risk that public authorities in particular will access personal data without adequate information and legal protection options.

This consent is given voluntarily and can be revoked at any time with effect for the future. You will not suffer any disadvantages if you do not give your consent. Without this consent, however, we cannot use Teams together with you. A simple message to us is sufficient for the revocation.

General, privacy risks

Microsoft Teams is part of the Office 365 cloud application, but can also be used separately as a cloud service under certain circumstances. The data processing when using this tool takes place technically at Microsoft on the servers operated by Microsoft. We have concluded an order processing contract with Microsoft and additionally agreed the so-called EU standard data protection clauses. Microsoft guarantees us a server location for the processed data in Europe. However, it cannot be ruled out that the data will also be transmitted to other countries, in particular the USA, or that access options exist from there, for example by Microsoft companies based there. Although Microsoft concludes contracts with the subcontractors involved, which are intended to guarantee an appropriate level of data protection, it also reserves the right to process customer data for its own business purposes. In addition, the ECJ has expressed doubts about the resilience of the agreed standard data protection clauses with Microsoft given the legal situation in the USA and the access possibilities there for American authorities. Therefore, there is a data protection risk in the context of data processing by Microsoft.


Type and purpose of processing

We only process your data to the extent necessary to conduct the online meeting. This serves our common interest in good communication with you (legal basis: Art. 6 Para. 1 S. 1 lit. f GDPR), but may also be necessary in individual cases to provide our services within the framework of a contract concluded with you (legal basis: Art. 6 para. 1 sentence.

As far as information is processed by our employees, this is additionally based on § 26 BDSG, since this data processing is usually necessary for the establishment, implementation or termination of an employment relationship. In addition, the data processing that necessarily takes place with reference to the USA within the framework of teams is based on your consent in accordance with Article 6 (1) sentence 1 lit.


When you participate in our online meeting, we receive and use your information to participate in the meeting. This is usually your name, e-mail address, identification if applicable, optional profile picture and other communication data. If you need further information in the context of chat functions and the like. share, these are also processed and can be saved in a chat history, insofar as we deem this necessary for documentation purposes.

These can contain the topic, a session number, information on the duration of the meeting, IP addresses of the connections involved, any telephone numbers used for the connection and additional information on the hardware used (e.g. microphone and camera, browser) that is mandatory for connectivity.

only whoIf you expressly agree, we can also make recordings. As a rule, however, this should be avoided. A running recording is also always displayed on your screen. You decide yourself whether to mute your microphone or switch off your camera. Automated decision-making according to Art. 22 GDPR does not take place.

Duration of storage, data economy

The content data of the online meeting is only saved by us if a recording is made (see above). Otherwise we do not store any personal data in this tool beyond the period required from a technical point of view.


However, if you are registered as a user with a service provider, further data about you in connection with your participation in the online meeting can also be stored by the respective provider on this basis. This and the storage period then depends on your usage relationship with the provider and is the sole responsibility of the provider.

We make sure that possible but not necessary further data processing, eg monitoring options (so-called "attention assistant"), which a video conference tool may offer, are deactivated by default.

Recipients and disclosure of data, third country

We will not transmit your data to third parties unless transmission is already part of the online meeting. Information from the online meeting is necessarily transmitted among the respective participants of the meeting.


EIt is also technically imperative that the infrastructure provider (see above) obtains knowledge of the online meeting data; in this respect, this is necessary for the technical implementation and there are also factual access options. The permissibility of access is limited by the order processing contract concluded with us, but is subject to the risks described above.
